The following constitute an agreement between you and Vetanea Private Limited {Pty Ltd} (ABN:11631346604) trading as Viti5 Australia (“Viti5”, “Vetanea”, “we” or “us”), the operator of the website www.viti5.com.au (“the Site”), in relation to the purchase of goods and services via the Site. These Terms and Conditions inclusive and represent Terms of Use, Terms of Purchase/Service and Privacy Policy (“the Additional Terms”), which will equally apply to your use of the Site, and all mentioned should be read in conjunction with these Terms and Conditions. If there is any inconsistency between these Terms of Purchase/Service, and the Additional Terms, in relation to your purchase of any goods or services via this Site, then these Terms and Condition prevail.

By purchasing goods or services via this Site, you signify that you agree to these Terms and Conditions, the Additional Terms, collectively called ‘VITI5 T&CS’ and you consent to resolve in accordance to the laws of the State of Queensland, Australia any dispute that you may have with us, the Site, or any purchase or attempted purchase of goods or services by you via the Site. Location of the dispute shall be in Brisbane, Queensland, Australia.

2. CHANGES TO THE TERMS AND CONDITIONS

We may change these Terms and Conditions at any time, as we deem appropriate. If we make changes we will update on the Site that the Terms and Conditions . Your ongoing purchase of goods or services via the Site after the changes take effect signifies your agreement to the new terms. We encourage you to review the Terms and Conditions regularly, including before each purchase made via the Site.

3. ORDERING OF GOODS

Our products including Vit’i5 Orange, Vit’i5 Blue and Vit’i5 Half-Half (“Product”, “Products”) are made in Australia with ingredients sources from various countries. Any order placed by you in the manner described on this Site is an offer by you to purchase a product at the advertised price (including delivery costs and other charges) specified on this Site at the time you place your order.
Orders are only accepted online and while stock lasts. You acknowledge that, by placing your order, you are agreeing to pay for and accept delivery of the goods ordered. It is your responsibility to ensure your details are correct, including email, shipping delivery and payment details. We take no responsibility if goods are delivered to the wrong address because of your failure to provide a correct delivery address when you fill up the delivery details at the point of purchase on this Site.
There is a transaction limit of $750.00 inclusive GST per order, excluding shipping fee. This limit may change from time to time without notice to you.
Prices published on this Site may change at any time determined by us. Prices of products placed in the ‘shopping cart’ but not paid for are also subject to change and you agree to pay the price current at the time of payment.

While every effort has been made to ensure the accuracy of prices and information displayed on the Site and related website pages, We reserves the right to accept or reject your payment offer for any reason, including without limitation, the unavailability of any product, an error in the price or the product description posted on the Site, or an error in your order, or we reasonably believe you have not complied with these Terms and Conditions, and the Additional Terms, or we have previously refused to accept any order(s) from you.

We may require additional verification or information before accepting any order. Verification required will be determined by us.

In Australia and in all other countries, we reserve the right to limit sales, including the right to prohibit sales to re-sellers.

We are not responsible for typographical or photographic errors on this website, including any such errors in relation to prices.

4. PRICES

Product availability and prices may vary between Australian/overseas retail stores and this Site due to different retailer offers. For deliveries within Australia, all prices are inclusive of the Australian Government’s Goods and Services Tax (GST), currently set at 10% of the price of all products, but subject to change. Prices displayed on this Site are current at the time of issue, but may change at any time and are subject to availability. Prices and availability of products/services are subject to change without notice. Products are sold for personal use only for pets (“Pet”, “Dog”, “Cat”) consumption. For professional (veterinarian that registered according to our requirement with our Site), special price conditions apply.

5. PAYMENTS

All prices listed on this Site are in Australian Dollars (AUD).
Payments can be made by Visa or Mastercard via Commbank Simplify plugin via Woocommerce platform. Unless otherwise specified, the price payable for goods or services ordered is the price specified on this Site, plus any applicable shipping and handling charges. Some overseas credit card might not be acceptable by our payment gateway. For overseas customer, an international transaction fee can/may be charged to you, by your credit card company when you purchase online with the credit card that was not issued in that particular country (Australia in our website). We do not responsible for any surcharge described as such by your credit card company. The total check-out price at our site are inclusive of GST for Australian deliveries; and exclusive of GST for all products shipped outside Australia.

6. DELIVERY

We use a third-party company with Warehousing, outsourced ecommerce order fulfillment & inventory management. We try to ensure that all Products are delivered in a prompt and timely manner. However, from time to time, it is possible that shipping and other factors outside of our control may result in delays. We do not accept any liability for loss or damage suffered by anyone as a result of any such delays and we shall not be liable for any inaccuracy of information provided in relation to the date and time of delivery.
Australia Shipping
Flat shipping up to 5kg of $9.50 + GST Australia Wide except a few rural places. Parcel more than 5kg will be calculated at check-out.
Delivery fees are subject to change without notice.

All shipping is with tracking. Each purchase will be shipped as a separate order and cannot be combined. Whenever possible in Australia, metropolitan cities such as Sydney, Melbourne and Brisbane orders will usually be delivered within 3-5 days of ordering. Adelaide, Hobart, Perth and all regional areas within approximately 5- 7 days. We cannot guarantee delivery times, including due to reasons beyond our control. All deliveries are made Monday – Friday via courier chosen by the order fulfillment company. You have the option to authorise courier to leave your package at the delivery address by ticking the ‘authority to leave’ box during checkout. There are no weekend deliveries.

You agree that We is not responsible for, and has no control over, the freight/postal service. You agree that We cannot be held liable for any shipping issues, delays or errors.
We use the order fulfillment company and we endeavour that your order should be dispatched on the same or next business day but this is not within our control. Thus, We have a very limited window of time to edit the detail of delivery from the time of an order being placed to being dispatched. Please ensure the correct selection of product and correct delivery address is being provided when placing the order. We do not responsible for the wrong address and wrong product that the customers selected at the time the order being placed. Once payment is completed and order is being fulfilled, we do not accept any liability for loss or damage suffered by anyone as a result of any such inaccuracy of information provided by the customer in relation to the address and selection of products in the order.
For most destinations, you will receive your order within 2-5 business days from when you’ve placed your order. Some remote destinations may take a little longer. We reserves the right NOT to ship to certain remote or rural locations, for example due to the unavailability of courier services.
International Shipping
You should check any import laws or regulations that would restrict the importation of the goods prior to purchase. Customs policies vary widely from country to country and region to region; you should contact your local custom office about the import of the products even it is for personal use for your pet. Due to customs regulations and circumstances beyond our control, we can only offer delivery of products to the following countries by Express option.
Country and delivery fee:
New Zealand – flat shipping up to 20kg parcel $25 + GST of delivery fee; parcel more than 20kg will be calculated at checkout
All International deliveries must be signed for.
INTERNATIONAL DUTIES & TAXES
Our retail prices and shipping charges exclude any local customs duties or taxes/VAT. Customs duties and taxes are additional fees charged by local authorities and vary country to country. The additional fees are the responsibility of the customer. We encourages customers to source this information prior to purchase. Unfortunately, We are unable to provide information relating to the cost of unexpected taxes or duties as these charges vary and are beyond our control.
When ordering from Viti5 Australia, the recipient is the importer of record and must comply with all laws and regulations of the destination country. Orders that are shipped to countries outside of Australia may be subject to import taxes, customs duties and fees levied by the destination country. The recipient of an international shipment may be subject to such import taxes, customs duties and fees, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by the recipient; We has no control over these charges and cannot predict what they might be. Customs policies vary widely from country to country and region to region; you should contact your local customs office for further information. When customs clearance procedures are required, it can cause delays beyond our original shipment delivery estimates.

We reserves the right not to deliver goods to certain countries. We is also not responsible for assuring the product can be lawfully imported to the destination country. When ordering from this site, for delivery outside Australia, you or the recipient of record must comply with all laws and regulations of the destination country. Accordingly, you should check any import laws or regulations that would restrict the importation of the goods prior to purchase.

7. TRACKING YOUR ORDER

Upon dispatch of your order, a consignment note number will be emailed to you for ease of reference. You may track the progress of your shipment at any time, via the designated shipping companies’ website tracking facilities. We might not be able to provide tracking information once shipment is transferred outside Australia.

8. SAFE ARRIVAL

We anticipate that all products are wrapped in parcel/box using protective cushioning for safe arrival. If there is any damage to the package content during the transit of the product prior to the arrival of parcel to you – please ensure you contact us with the complaint and to include your order number which was emailed to you upon processing of your order. We may request that you provide us with a picture of the damaged goods.
We do not responsible for parcel that gone missing or stolen if you have provided consent to leave a parcel without signature. We do not responsible for replacing that parcel.

9. RETURNS POLICY

Our policy lasts 30 days, that means if 30 days have gone by since your purchase, then we cannot offer you a refund or exchange.

We do not accept returns for simply changing your mind after purchase.

We only accept returns
– in the circumstance where the wrong product is mistakenly dispatched and delivered to you, then you must return and we will exchange and deliver the correct product to you.
– In the circumstance where the product you received and presented with faulty packaging that causes the product is not suitable to be used thus required a return and exchange
To be eligible for a return, your item must be unopened, unused and in the same condition that you received it. It must also be in the original packaging.

Despite the above, nothing in these Terms and Conditions alter any rights you may have under the Australia Consumer Law (ACL). Please ensure you retain proof of purchase of purchasing products from our Site and the goods in question if you are looking at returning your goods. To request a return or a refund, please email admin@viti5.com.au to ensure you include
– your order number which was emailed to you upon processing of your order
– reason of return
– proof of purchase
– photos of related product which you received and presented with faulty packaging that causes the product is not suitable to be used thus required a return and refund

Refunds (if applicable)
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

Late or missing refunds (if applicable)
If you haven’t received a refund yet, first check your bank account again.
Then contact your credit card company, it may take some time before your refund is officially posted.
Next contact your bank. There is often some processing time before a refund is posted.
If you’ve done all of this and you still have not received your refund yet, please contact us at admin@viti5.com.au.

Sale items (if applicable)
Only regular priced items may be refunded, unfortunately sale items cannot be refunded.

Exchanges (if applicable)
We only replace items if they are defective or damaged. If you need to exchange it for the same item, send us an email at admin@viti5.com.au and send your item to: PO Box 5105, Daisy Hill QLD 4127 AUSTRALIA.

Shipping
To return your product, you should mail your product to: PO Box 5105, Daisy Hill QLD 4127 AUSTRALIA.

You will be responsible for paying for your own shipping costs for returning your item. Shipping costs are non-refundable.

Depending on where you live, the time it may take for your exchanged product to reach you, may vary.

You should consider using a trackable shipping service or purchasing shipping insurance. We don’t guarantee that we will receive your returned item.

All refund payments will be processed in Australian Dollars and We will not be held liable for any difference in the value of the refund against the initial purchase price in the final currency you used to purchase the products. We will not be liable to refund any fees or charges you incurred from your credit/debit card provider for your initial purchase.

For overseas return, we do not responsible for the delivery of return.

10. TITLE AND RISK

Title to the goods purchased on this Site does not pass from We to you until we have received payment in full for the goods. Risk in the goods will pass upon delivery of the goods.

In case of any complain at reception, the customer shall make a picture describing as well as possible the problem and send the picture and description to our customer service by email at admin@viti5.com.au to discuss the best option for any issue that may arises.

Vetanea’s total liability to you in relation to any goods and sale (including a claim in tort, indemnity or under statute) is limited to the Sale Price of the related sale.

Neither party shall be liable to the other in respect of any consequential or indirect loss or damage (including without limitation loss of profit or production, loss of use, cost of capital or loss of opportunity) arising out of any default, omission or negligence in the performance, or purported performance, of that party’s obligations in connection with the Terms of Use, Terms of Purchase/Service and Privacy Policy.
